Rules for Port Royal Escape Raffle

Leadership Tallahassee, Inc. (LT) is a non-profit tax-exempt organization under federal and state laws, and is located at 100 N. Duval Street, Tallahassee, Florida 32302-1639.

LT is conducting this Port Royal Escape! raffle, pursuant to Florida Statute Section 849.0935, as a way to raise funds for the community leadership development programs of LT. The official rules and regulations of the Port Royal Escape! raffle are set forth below. By purchasing a raffle ticket, you agree to be bound by these rules and regulations. LT's interpretation and application of the rules and regulations shall be final.

Tickets

Raffle tickets are $50 each, and payable to LT. No purchase or contribution is necessary. You must be a dues paying member of Leadership Tallahassee to buy a raffle ticket. Raffle tickets must be purchased by February 11, 2010. Only ticket holders with validly paid tickets are eligible to participate in the raffle. No refunds are available. LT assumes no responsibility for lost, late, misdirected or non-delivered mail or other failure to deliver tickets prior to any deadline. Purchases of raffle tickets are not tax-deductible contributions. LT reserves the right to limit the number of tickets distributed to each person. Tickets may be purchased from an agent of LT, and paid for with cash, check or credit card. You may buy as many available tickets as you want. Only 100 tickets for $50 each will be sold.

The winning ticket will be drawn at random February 2, 2010, from all eligible raffle tickets received. Ticket holders need not be present to win. The winner will be notified by email and phone. The odds of winning the prize are out of a maximum of 100 of the raffle tickets sold.

Eligibility

All federal, state, and local laws and regulations apply. The raffle is void where prohibited or restricted by law. If it is determined that this raffle is not permitted in any other jurisdiction the refund is limited to the lesser of the price contributed or $100 per ticket.

The winner must claim his or her prize after notice of the award. If the winner does not claim the prize within 30 days of notification, such winner will be deemed to have forfeited his or her prize and another winner will be selected for such prize. You may take up to a year to use the Naples vacation home. Winner may not transfer the right to use of the Naples vacation home. Winner must arrange with the owner for available dates. Some restrictions may apply, but owner will try to accommodate reasonable requests. Winner must give at least one month's notice to owner before using vacation home. The winner will be given the contact information for the owner.

By purchasing a raffle ticket, you agree to be bound by these Official Rules and Regulations and the decisions of LT, which shall be final. LT is not responsible for any injuries, losses or damages of any kind arising in connection with or as a result of the winner's acceptance or use of any prize. By entering the raffle, each participant releases LT, its directors, officers, employees, and agents from any and all liability for injuries, losses or damages of any kind caused by any prize or resulting from acceptance, possession, use or misuse of any prize, and the winner agrees to indemnify and hold LT harmless from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of the winner's acceptance or use of any prize.

THERE ARE NO REPRESENTATIONS OR WARRANTIES OTHER THAN AS SET FORTH IN THESE OFFICIAL RULES AND REGULATIONS. LT DISCLAIMS ALL OTHER REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE RAFFLE, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. A RAFFLE PARTICIPANT'S SOLE AND EXCLUSIVE REMEDY FOR LEADERSHIP TALLAHASSEE SHALL BE LIMITED TO THE RETURN OF THE PURCHASE PRICE PAID FOR HIS OR HER RAFFLE TICKET(S). IN NO EVENT SHALL LT BE LIABLE TO ANY PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF LT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ANY CLAIM OR DISPUTE AGAINST LT WITH RESPECT TO THE RAFFLE MUST BE BROUGHT WITHIN ONE YEAR AFTER THE CAUSE OF ACTION ARISES.
